en este escrito se hará un acercamiento a los conceptos de existencia y estar-en-el-mundo de Heidegger, tal como son expuestos en Ser y tiempo, es decir, a partir de la hermenéutica del Dasein, aunque en algunos pasajes se recurrirá, también, a otras obras del autor alemán, ya sea para matizar o reforzar ciertos aspectos del asunto. Asimismo, se buscará mostrar cómo dichos conceptos se relacionan y se enmarcan en una investigación más amplia sobre la pregunta por el sentido del ser. (...) En síntesis, el objetivo de este escrito es desarrollar un acercamiento a los conceptos de existencia y ser-en-el-mundo o estar-en-el-mundo y su relación y lugar dentro de la indagación heideggeriana que se cuestiona por el sentido del ser. Además, se indicarán, a grandes rasgos, algunas similitudes y vínculos entre el pensamiento de Heidegger y el de Ortega y Gasset y Sartre, teniendo siempre como puntos de referencia los conceptos centrales que aborda este trabajo. Por último, se considerará si las lecturas filosóficas de los autores examinados aún son adecuadas para describir el fenómeno de la vida, vale decir, al ser humano y su existencia concreta. (shrink)

Este escrito se propone exponer, desarrollar y fundamentar, a grandes rasgos, un cuestionamiento interpretativo sobre la vinculación entre J. Rancière y L. Althusser, específicamente en torno a la concepción de policía del primero y de aparato de Estado del segundo. Es conocido que, en una primera etapa, Rancière fue cercano al pensamiento de Althusser, pero nunca un adherente del mismo. No obstante, en su pensamiento político se pueden hallar residuos y vestigios que parecieran dar cuenta de aquella primera relación intelectual (...) que se trazó como un cruzamiento entre ambos autores. Teniendo esto en mente, se vuelve menos descabellado el plantear lo siguiente como eje de este texto: que la caracterización de lo policiaco o de la policía, tal como está en algunos textos de Rancière, tiende a insinuar un cierto símil con la noción de aparato de Estado, propia del marxismo althusseriano, en tanto que se considera a este último en su duplicidad o doble faceta: aparato represivo de Estado y aparatos ideológicos de Estado. ¿Es plausible una lectura interpretativa que se maneje en esta clave, siguiendo esta intuición pese a todas las objeciones que se alzan a la brevedad? Resumen: El presente trabajo ofrece un análisis del diccionario Nuevos chilenismos con el objetivo de identificar los principales aspectos culturales presentes en esta obra chilena de principios del siglo XX. Gracias a un enfoque metodológico sustentado en la teoría fundamentada, es posible establecer que dentro de los aspectos culturales con mayor presencia destaca la conformación de la identidad lingüística chilena, lo que se evidencia a través de la valoración social que ofrece el autor de la norma nacional y, además, la (...) oposición que establece entre esta y la norma peninsular.: This work offers an analysis of the New Chileanisms dictionary with the objective of identifying the main cultural aspects present in this Chilean work of the beginning of the XXth century. Thanks to a methodological approach based on grounded theory, it is possible to establish that within the cultural aspects with greater presence highlights the conformation of Chilean linguistic identity, which is evidenced through the social assessment offered by the author of the national standard and, in addition, the opposition established between it and the peninsular norm. BackgroundAlthough gait patterns disturbances are known to be related to cognitive decline, there is no consensus on the possibility of predicting one from the other. It is necessary to find the optimal gait features, experimental protocols, and computational algorithms to achieve this purpose.PurposesTo assess the efficacy of the Stable Sparse Classifiers procedure for discriminating young and healthy older adults, as well as healthy and cognitively impaired elderly groups from their gait patterns. To identify the walking tasks or combinations of tasks (...) and specific spatio-temporal gait features that allow the best prediction with SSC.MethodsA sample of 125 participants was studied. They underwent assessment with five neuropsychological tests that explore different cognitive domains. A summarized cognitive index, based on the Mahalanobis distance from normative data, was calculated. The sample was divided into three groups using k-means clustering of MDCog in addition to Age. The participants executed four walking tasks and their gait patterns, measured with a body-fixed Inertial Measurement Unit, were used to calculate 16 STGF and dual-task costs. SSC was then employed to predict which group the participants belonged to. The classification's performance was assessed using the area under the receiver operating curves and the stable biomarkers were identified.ResultsThe discrimination HE vs. MCI-E revealed that the combination of the easy dual-task and the fast walking task had the best prediction performance. The features related to gait variability and to the amplitude of vertical acceleration had the largest predictive power. SSC prediction accuracy was better than the accuracies obtained with linear discriminant analysis and support vector machine classifiers.ConclusionsThe study corroborated that the changes in gait patterns can be used to discriminate between young and healthy older adults and more importantly between healthy and cognitively impaired adults. A subset of gait tasks and STGF optimal for achieving this goal with SSC were identified, with the latter method superior to other classification techniques. (shrink)

We give upper and lower bounds for the strength of ordinal definable determinacy in a small admissible set. The upper bound is roughly a premouse with a measurable cardinal $\kappa$ of Mitchell order $\kappa^{++}$ and $\omega$ successors. The lower bound are models of ZFC with sequences of measurable cardinals, extending the work of Lewis, below a regular limit of measurable cardinals.

Recent advances in the field of statistical learning have established that learners are able to track regularities of multimodal stimuli, yet it is unknown whether the statistical computations are performed on integrated representations or on separate, unimodal representations. In the present study, we investigated the ability of adults to integrate audio and visual input during statistical learning. We presented learners with a speech stream synchronized with a video of a speaker’s face. In the critical condition, the visual (e.g. /gi/) and (...) auditory (e.g. /mi/) signals were occasionally incongruent, which we predicted would produce the McGurk illusion, resulting in the perception of an audiovisual syllable (e.g. /ni/). In this way, we used the McGurk illusion to manipulate the underlying statistical structure of the speech streams, such that perception of these illusory syllables facilitated participants’ ability to segment the speech stream. Our results therefore demonstrate that participants can integrate audio and visual input to perceive the McGurk illusion during statistical learning. We interpret our findings as support for modality-interactive accounts of statistical learning. (shrink)

This Article uses major and recent CJEU labor law case as a springboard to examine and critique the CJEU’s doctrinal frameworks, conceptual constructs and decision-making practice. It analyzes the institutional, legal, political and other consequences of the CJEU’s Viking judgment as a means of critiquing the Court’s increasingly profligate yet systematic approach to fundamental rights and freedoms. The resulting description claims that the European legal order is increasingly characterized by omnipresent layers of powerful judges who explicitly “balance” fundamental rights and (...) freedoms to resolve hotly contested social issues, even when those issues manifest themselves as private law disputes. The Article explains how the imposition of the CJEU’s “fundamentalist” framework impacts powerfully upon, and increasingly threatens, the domestic labor law regimes of Europe. The Article leverages this example to advance several general critiques of the Court’s increasingly dominant “fundamentalist” approach. The Court’s approach fails to treat fundamental rights as fundamental in any meaningful sense. It tramples unnecessarily on important institutional and jurisdictional distinctions, mistakenly redistributing competences not only between Member States and the European Union, but also within the Member States themselves. Finally, the Court’s approach increasingly subsumes all domestic institutions and individuals under a single, undifferentiated and ultimately simplistic normative schema that preempts many of the institutional structures and solutions that might - and in many cases, recently did - skillfully govern significant portions of the European legal field. Judicial Deliberations compares how and why the European Court of Justice, the French Cour de cassation and the US Supreme Court offer different approaches for generating judicial accountability and control, judicial debate and deliberation, and ultimately judicial legitimacy. Examining the judicial argumentation of the United States Supreme Court and of the French Cour de cassation, the book first reorders the traditional comparative understanding of the difference between French civil law and American common law judicial decision-making. It then uses this analysis (...) to offer the first detailed comparative examination of the interpretive practice of the European Court of Justice. Lasser demonstrates that the French judicial system rests on a particularly unified institutional and ideological framework founded on explicitly republican notions of meritocracy and managerial expertise. Law-making per se may be limited to the legislature; but significant judicial normative administration is entrusted to State selected, trained, and sanctioned elites who are policed internally through hierarchical institutional structures. The American judicial system, by contrast, deploys a more participatory and democratic approach that reflects a more populist vision. Shunning the unifying, controlling, and hierarchical French structures, the American judicial system instead generates its legitimacy primarily by argumentative means. American judges engage in extensive debates that subject them to public scrutiny and control. The ECJ hovers delicately between the institutional/argumentative and republican/democratic extremes. On the one hand, the ECJ reproduces the hierarchical French discursive structure on which it was originally patterned. On the other, it transposes this structure into a transnational context of fractured political and legal assumptions. This drives the ECJ towards generating legitimacy by adopting a somewhat more transparent argumentative approach. (shrink)

If affirmative action and other ethnicity-based social programs are justified, then J. Angelo Corlett believes it is important to come to an adequate understanding of the nature of ethnicity in general and ethnic group membership in particular. In Race, Racism, and Reparations, Corlett reconceptualizes traditional ideas of race in terms of ethnicity. As he makes clear, the answers to the questions "What is a Native American?" or "What is a Latino?" have important implications for public policy, especially for those (...) programs designed to address historic injustices and economic and social imbalances among different groups in our society. Having supplanted "race" with a well-defined concept of ethnicity, the author then analyzes the nature and function of racism. Corlett argues for a notion of racism that must encompass not only racist beliefs but also racist actions, omissions, and attempted actions. His aim is to craft a definition of racism that will prove useful in legal and public policy contexts. Corlett places special emphasis on the broad questions of whether reparations for ethnic groups are desirable and what forms those reparations should take: land, money, social programs? He addresses the need for differential affirmative action programs and reparations policies—the experiences of different ethnic groups vary greatly. Arguments for reparations to Native and African Americans are considered in light of a variety of objections that are or might be raised against them. Corlett articulates and critically analyzes a number of possible proposals for reparations. (shrink)

The standard view in social science and philosophy is that lying does not require the liar’s assertion to be false, only that the liar believes it to be false. We conducted three experiments to test whether lying requires falsity. Overall, the results suggest that it does. We discuss some implications for social scientists working on social judgments, research on lie detection, and public moral discourse.

‘Epistemic structural realism’ (ESR) insists that all that we know of the world is its structure, and that the ‘nature’ of the underlying elements remains hidden. With structure represented via Ramsey sentences, the question arises as to how ‘hidden natures’ might also be represented. If the Ramsey sentence describes a class of realisers for the relevant theory, one way of answering this question is through the notion of multiple realisability. We explore this answer in the context of the work of (...) Carnap, Hintikka and Lewis. Both Carnap and Hintikka offer clear structuralist perspectives which, crucially, accommodate the openness inherent in theory change. Unfortunately there is little purchase for a viable form of realism in either case. Lewis’s approach, on the other hand, offers more scope for realism but, as we shall see, concerns arise as to whether a relevant form of structuralism can be maintained. In particular his thesis of Ramseyan humility undermines certain conceptions of scientific laws that the structural realist might naturally cleave to. Our overall conclusion is that the representational device of Ramsey sentence plus multiple realisability can accommodate either the structuralist or realist aspects of ESR but has difficulties capturing both. We provide a new wrinkle to the Argument from Unfair Advantage, a rather popular one in the ethics of doping in sports discussions. But we add a new argument that we believe places the moral burden on those who favor doping in sports. We also defend our position against some important concerns that might be raised against it. Munch-Jurisic’s account of perpetrator disgust raises important new questions concerning the complexity of emotions and their connection with moral actions. In this commentary, we discuss this account by applying some of the author’s ideas to the case of anger. We suggest that just as the relations between disgust and moral action are much more nuanced than previously thought, as Munch-Jurisic explains, analyses of anger can also profit from a more careful approach to such connections. Specifically, we propose that contextual factors (...) can affect the moral character of anger reactions, which in turn can provide them with moral value. We also argue that the contextual view deployed to study disgust reactions can also support distinctions between core forms and socio-moral forms of the same emotion, which in turn raises interesting questions concerning different forms of anger. Lastly, we extend the contextual approach to problems of emotion individuation and theories in emotion science, showing how current scientific emotion theories can learn from a detailed examination of disgust, anger, and other context-sensitive emotions. We aim to highlight some important contributions of Munch-Jurisic’s work to broader discussions on emotions, morality, and how to theorize about emotions overall. (shrink)

Starting from a recent paper by S. Kaufmann, we introduce a notion of conjunction of two conditional events and then we analyze it in the setting of coherence. We give a representation of the conjoined conditional and we show that this new object is a conditional random quantity, whose set of possible values normally contains the probabilities assessed for the two conditional events. We examine some cases of logical dependencies, where the conjunction is a conditional event; moreover, we give the (...) lower and upper bounds on the conjunction. We also examine an apparent paradox concerning stochastic independence which can actually be explained in terms of uncorrelation. We briefly introduce the notions of disjunction and iterated conditioning and we show that the usual probabilistic properties still hold. (shrink)

Limited health literacy is a pervasive and independent risk factor for poor health outcomes. Despite decades of reports exhibiting that the healthcare system is overly complex, unneeded complexity remains commonplace and endangers the lives of patients, especially those with limited health literacy. In this article, we define health literacy and describe the empirical evidence associating health literacy and poor health outcomes. We recast the issue of poor health literacy from within the ethical perspective of the least well-off and argue that (...) poor health outcomes deriving from limited health literacy ought to be understood as a fundamental injustice of the healthcare system. We offer three proposals that attempt to rectify this injustice, including: universal precautions that presume limited health literacy for all healthcare users; expanded use of technology supported communication; and clinical incentives that account for limited health literacy. This paper investigates the nature of emotional experience in relation to the senses, and it defends the thesis that emotional experience is partly non-sensory. In §1 I introduce my reader to the debate. I reconstruct a position I call ‘restrictivism’ and motivate it as part of a reductive approach to mind’s place in nature. Drawing on intuitive but insightful remarks on the nature of sensation from Plato, I map out the conditions under which the restrictivist thesis is both substantive and (...) plausible. I then present two arguments against it. The first argument, which I lay out in §2, draws on recent empirical results in emotion research to show that restrictivism cannot be reconciled with the possibility of knowledge of one’s own emotional state by acquaintance. The second argument, which I present in §3, individuates a claim on which most contemporary theories of emotional valence converge and uses it to demonstrate that restrictivism has a false implication: it must deny that valence is experientially felt. By appealing to the reception of the myth in Western Civilization, this article searches for the influences that it may have in the formation of images of identity created about America. Attention is paid to the topic of images that proliferate and the disputes surrounding the mode of naming these territories, as a privileged locus from where to trace the implicit conflicts of what we are. The present paper reveals (non-relativistic) quantum mechanics as an emergent property of otherwise classical ergodic systems embedded in a stochastic vacuum or zero-point radiation field (zpf). This result provides a theoretical basis for understanding recent numerical experiments in which a statistical analysis of an atomic electron interacting with the zpf furnishes the quantum distribution for the ground state of the H atom. The action of the zpf on matter is essential within the present approach, but it is the ergodic demand (...) what ultimately leads to the matrix formulation of quantum mechanics. The paper thus represents a step forward in the quest for an elucidation of the fundamentals of quantum mechanics. (shrink)

El marco teórico desde el cual se llevan a cabo investigaciones acerca de la pseudociencia es deficiente, dado que suele incluir otros tipos de creencias carentes de garantía epistémica. En este artículo, se repasarán los mecanismos de explotación de la autoridad científica por parte de la pseudociencia, desarrollando así un marco psicocognitivo más refinado para caracterizar el fenómeno. Se analizará la psicología del engaño pseudocientífico, las raíces cognitivas que posibilitan la epidemiología de este tipo de ideas y sus mecanismos de (...) autolegitimación, como la superioridad dialéctica, el falso apoyo externo o la falsa superioridad ética y/o epistemológica. Lougheed, in his paper ‘African vital force and the permissibility of euthanasia’,1 offers a non-western perspective rooted in African traditions, broadening the debate on euthanasia by emphasising the importance of culture and context. We first challenge Lougheed’s stance that being an object of harmonious relationships serves as an argument against the permissibility of a patient requesting euthanasia. Then, based on the Latin American (LATAM) experience and by introducing the concept of relational autonomy, we aim to further contribute to Lougheed’s call (...) for a broader dialogue on euthanasia that incorporates non-western values. A communitarian approach, rather than necessarily opposing euthanasia, can support the right to it by promoting both individual dignity and collective well-being. Although ethical norms are highly influenced by culture, certain ethical principles, such as ‘respect for persons’, should be universal.2 Considering Kant’s categorical imperative, ‘ So act as to treat humanity, whether in your own person or in another, always as an end and never as only a means ’, as the foundation of the principle respect for persons, Lougheed’s argument against the permissibility of euthanasia grounded on a person being the object of something for someone else, neglects this universal principle. While some individuals in collectivistic societies would give more weight to the benefits to others when considering ending their own lives, and we acknowledge that patients with advanced illnesses or in end-of-life processes can still nurture harmonious and meaningful relationships, …. El presente artículo de revisión analiza las convergencias y diferencias entre el pensamiento complejo y laecología de saberes con el propósito de explorar posibilidades de complementación y sinergias en el marco de una epistemología crítica. Para tal efecto se ha realizado una revisión bibliográfica apoyada por los métodos deductivo y hermenéutico. Para la caracterización del pensamiento complejo se ha revisado la obra de Edgar Morin y otros autores como Boaventura de Sousa Santos. De la revisión se concluye que tanto el (...) pensamiento complejo como la ecología de saberes tienen similitudes pues comparten en mayor o menor medida los principios de sistemas organizados, dialogicidad, recursividad y retroactividad. Además, son explícitos en superar la distinción sujeto-objeto para pasar a una relación sujeto-sujeto. Ambas propuestas constituyen alternativas al pensamiento científico hegemónico y ponen el valor el pluralismo cognitivo y la justicia cognitiva. La principal diferencia es que la ecología de saberes tiene una apuesta más explícita por los conocimientos de los movimientos sociales en sus luchas de resistencia frente a las diversas formas del colonialismo vigente, que tienen correlato con un sistema económico que privilegia el mercado a la vida. En tal sentido es posible reconocer en la ecología de saberes un carácter más político. Ambas propuestas, aunque con diferencia de grados, se erigen como alternativas transformadoras de la realidad social. (shrink)

This paper explores the contextual value of solitude in learning; in so doing, it attempts to suggest an alternative method of instruction that is based on aesthetics as the reciprocal relationship between emotions and intellect, and between action and contemplation. Such an aesthetic education or method seeks to guide the student towards the attainment of her own life: to perfect, as much as possible, her human qualities in what she does by paying attention to the things of Beauty. The method (...) that the essay uses is both historical and interdisciplinary: it draws from theology, philosophy, the sciences and visual art; and, it is guided by an explanatory perspective that is constructive. Experiments in cognitive neuroscience build a setup whose set of controlled stimuli and rules elicits a cognitive process in a participant. This setup requires researchers to decide the value of quite a few parameters along several dimensions. We call ‘’contextual factors’’ the parameters often assumed not to change the cognitive process elicited and are free to vary across the experiment’s repetitions. Against this assumption, empirical evidence shows that many of these contextual factors can significantly influence cognitive performance. Nevertheless, it is (...) not entirely clear what it means for a cognitive phenomenon to be context-sensitive and how to identify context-sensitivity experimentally. We claim that a phenomenon can be context-sensitive either because it is only triggered within a specific context or because different contexts change its manifestation conditions. Assessing which of these forms of context-sensitivity is present in a given phenomenon requires a criterion for individuating it across contextual variations. We argue that some inter-level experiments that, within the mechanistic approach to explanation, are required to identify relations of constitutive relevance between a phenomenon and a mechanism, are also necessary for individuating the phenomenon across its contextual variations. We articulate a criterion according to which behavioral variations across contexts indicate different phenomena if and only if the mechanistic activities, components and/or organizational properties recruited in each context are different. We support this approach by showing how it is applied in paradigmatic studies addressing cognitive performance differences resulting from contextual variations of task features, such as stimulus type and response modality. Finally, we address the challenge that a form of context-sensitivity possessed by the so-called ‘multifunctional mechanisms’ is incompatible with our proposal because it entails that the same mechanism can be recruited in different contexts to produce different phenomena. We examine key cases of multifunctionality and argue that they are consistent with our proposal because a single mechanism can have different components, activities and/or organizational properties in different contexts. Thus, these modifications may not affect the identity of a mechanism, and they could explain how it produced different phenomena in those contexts. (shrink)

The volume is the first treatment in the Italian language, introductory yet as complete and up-to-date as possible, of Virtue Ethics, a current of contemporary ethics that is still relatively unknown and underdeveloped in continental Europe, which centers around the notion of virtue. Although this term is not particularly used or appreciated in today's common language, the interest it has generated in recent decades allows Virtue Ethics to be presented as a true branch of contemporary ethics with classical roots, distinguishing (...) itself from deontological and utilitarian-consequentialist approaches. After a review of the main authors associated with Virtue Ethics, the book examines its most relevant and debated conceptual points from a thematic or problem-based perspective, highlighting the connections between virtues and other dimensions of human action. Nuestro objetivo consiste en identificar los derechos conquistados y contribuir a la reivindicación de nuevos derechos, permitiendo dinamizar el compromiso público feminista con los cuidados y la vida social/comunitaria en el espacio público. Actualmente, en el ámbito de lo público se reflexiona sobre la transición necesaria del sistema de (...) servicios de cuidados desde lo público-privado a lo público-social/comunitario. Este modelo pone en valor sus especificidades, proximidad y calidad, como una fuente de democratización, inclusión y cohesión social. (shrink)
